Bankruptcy Fees

Setting reasonable and appropriate fees is one of the most difficult things for a Bankruptcy law firm to do. All of our clients are suffering some sort of financial hardship or they would not be seeking our services. At the same time, however, providing high quality representation in complex Bankruptcy proceedings is very expensive and requires a great deal of work and time. The new Bankruptcy Reform Law has made it even more expensive due to the large amount of documentation and other paperwork that is now required.

We have done our best to set our fees as low as possible to allow us to continue to provide quality, effective service to our clients. However, every case is different and our fees do vary. Thus it is impossible (and would be unfair to our clients) to list exact fees here on our website.

Chapter 7 Bankruptcy Fees

If you are quoted a price for a Chapter 7 Bankruptcy, always ask whether it includes the following (which are required for any case and would be in addition to the attorneys fees).

Description Fee Paid To
Bankruptcy Court’s Filing Fee
(required in ALL cases)
$306 Court
Homestead Deed Filing Fee
(required in MOST ALL cases)
$21 Court
Credit Counseling
(required BEFORE case may be filed)
$25 to $50 Approved Credit Counselor
Debtor Education
(can be paid after case is filed but is required BEFORE case may be discharged and closed by the Court)
$25 to $50 Approved Credit Counselor

Chapter 13 Bankruptcy Fees

In most cases, only the Court’s Filing Fee of $281.00 and the required credit counseling, credit report, and other out of pocket expenses must be paid prior to the filing of the case. Typically, all Attorney Fees will be paid through the Chapter 13 repayment plan over time.

Initial Non-Refundable Deposit to Start Work on Your File

After your consultation, if you decide to move forward with a bankruptcy filing with our office we ask that you make an initial non-refundable deposit of $100.00 to be applied toward the total cost of your bankruptcy – regardless of whether you decide to do a Chapter 13 or 7. You do not have to make this payment right away, but we are not able to begin work on your file until such payment is made. Once this payment is made, we will provide you with a copy of your consolidated 3-bureau credit report as well as instructions and a payment coupon for obtaining your required pre-bankruptcy credit counseling so that you can go ahead and complete that course. Also, upon request, we will provide you with a letter of representation that you may share with your creditors to reduce the amount of direct collection calls and communications you receive.
